DISTRICT: 'Congestion charge'-type plan to drive through parts of Epping Forest

Motorists could have to pay a daily 'congestion charge'-type fee to drive through parts of Epping Forest under a Clean Air Zone scheme supported by Epping Forest District Council.

The council's Interim Air Pollution Strategy includes a Clean Air Zone (CAZ) charging scheme for petrol and diesel vehicles from 2025.

Loughton Residents Association (LRA) which, with Green Party councillors, demanded a 'call-in' of the adoption of the strategy, told Everything Epping Forest a CAZ would be similar to the London Congestion Zone with most petrol and diesel private and commercial vehicles entering a zone around and including the Epping Forest Special Area of Conservation facing a similar charge.

LRA councillor Chris Pond told Thursday's overview and scrutiny committee, which heard the call-in, that it could mean a £12.50 charge to drive from Theydon Bois to Epping.

An LRA statement, issued after the call-in was defeated 7-5 with five abstentions, stated: "The council is trying to avoid the effect of laws which prohibit the building of new homes if the effect of the extra residents (singly or along with other new homes) would adversely affect the EFSAC (Epping Forest Special Area of Conservation). 

"A backlog of planning applications for developments large and small has built up over the last 18 months, and understandably those developers affected are putting pressure on the council to resolve the issue.

"By introducing an Interim Air Pollution Strategy and committing themselves to introducing a CAZ in 2025 the council are aiming to resolve the situation. 

"However, it does not lie wholly in the council’s power to introduce a CAZ - they will need to get various other bodies to agree, or in order to do so alone they may need to put a Private Bill through Parliament. All this without any apparent public consultation.

"Our understanding is that, without any absolute certainty that the CAZ will in fact be introduced, the Interim Strategy may not meet the relevant legal requirements for protecting the EFSAC."

The main routes affected by the CAZ would be the A121 (High Road/Goldings Hill), A104 (Epping New Road), A121 Woodredon Hill and the A1069 (Rangers Road).

The LRA statement added: "LRA believes the principal way of preventing further damage being done to the forest should be severely restricting extra housing near the forest, not by a cumbersome charging system which would be in danger of diverting traffic into residential areas and alienating residents’ support."

A council report on the adoption of the strategy states: "The introduction of a CAZ (Clear Air Zone) covering the SAC (Special Area of Conservation) from 2025 would involve charging people driving certain types of vehicle through the zone based upon the age and type of their vehicle. 

"The aim is to encourage motorists to replace older vehicles with newer vehicles compliant with the latest emissions standards, and in particular Ultra-Low Emission Vehicles (ULEVs), through a graduated charging system (for example, zero charge for ULEV owners or an increased charge for petrol car owners). 

"It would potentially also encourage those motorists who were able to, to use other routes instead of using roads in close proximity to the Epping Forest SAC."

The report adds: "The council recognises that the implementation of a CAZ will not come without some impact on residents and businesses across the district but it also has a legal responsibility to ensure that it can support the delivery of new homes and jobs without having an adverse effect on the integrity of the Epping Forest SAC."

Speaking during the call-in debate, LRA councillor David Wixley said: "I think it's unfortunate that this has come about this way. If ever a document warranted a briefing for all members to attend it would be this document."

Councillor Steven Neville highlighted issues with the feasibility of electric charging points at residents' homes and the fact that any CAZ would require Government consent and would have to feature in the council's Local Plan.

LRA councillor Howard Kauffman said the issue is "so fundamental to the health and wellbeing of our residents" adding: "It's a matter of great gravity".

He added: "The forest is 90 per cent of our district. The forest is massively suffering from pollution but I do feel this issue should have been dealt with in a more transparent and collegiate manner."

Councillor Sheree Rackham said it was a "big" issue but something "we need to look into deeply and implement".

Councillor David Dorrell said there was a "pressing need" for a "meaningful consultation" rather than "just impose it on them (the electorate)".

In reply to a question from Mr Dorrell about planned consultation, Nigel Bedford, portfolio holder for community and partnership services,  said there would be consultation "on the final scheme" while planning officer Alison Blom-Cooper added there would be consultation at various stages.

Mr Bedford said: "I dare say some residents will object to it (a Clean Air Zone)."

Independent Loughton councillor Stephen Murray highlighted the lack of consultation with all district councillors over the draft strategy and defended the call-in which had been criticised in a council media release. 

"The call-in is the only mechanism for this discussion. We have all benefited from the discussion (at overview and scrutiny committee) but it wouldn't have happened without the call-in."

He said: "We all understand the importance of the SAC (Special Area of Conservation). We love our forest. That's one of the reasons why people want to live in Epping Forest.

"The SAC is regarded as one of the most important in western Europe.

We have more ancient trees in Epping Forest than they have in the whole of France. 
"We are talking about something that is really significant."
