Welcome to this week’s e-news.
Well there is less than two weeks to go until our North East Construction Summit and we are delighted to announce that the CITB will also be presenting on future skills. There are still places available and if you haven’t already booked I urge you to do so as we have a fine array of speakers and exhibitors too. Further details are below and we also have a few exhibition space opportunities available too.
On Friday, Leanne attended the G4C AGM in Birmingham along with Eve Wilson and Natalie Keyes from our G4C North East Committee. The meeting discussed the proposal of new communication methods between all regional G4C networks, promotion about G4C and how to assist young professionals coming into the industry. Watch this space for more exciting things to take shape for G4C in the forthcoming months.

Tomorrow, we see the return of the First Friday Club which will be held at the Crowne Plaza Hotel in Newcastle and I understand it’s going to be a full house this time and look forward to catching up with many of you there. The next First Friday Club will be held in October and sponsorship opportunities are available.
Next week we have a few events taking place, the first being on Tuesday which is a joint event with NAWIC on Social Value in Construction at the offices of Thirteen Group in Middlesbrough. Then on Wednesday it is the continuation of the DAC Beachcroft series of events delivered by Roddy Gordon.
To end the week of events, on Thursday evening we have our G4C End of Summer BBQ which we are holding in conjunction with RTPI Young Planners at the Bridge Tavern in Newcastle. The Association for Project Safety announces Lesley McLeod as the new CEO
 The Association for Project Safety (APS) has announced the appointment of Lesley McLeod as their new CEO beginning her appointment on Monday 19th September. Lesley joins APS from Energy UK, where she was Board Director, Communications and Public Affairs.
APS President, Richard Wilks said: I am delighted that Lesley is joining us. She brings director level experience of two membership organisations, exceptional campaigning experience, financial acumen and a profound commitment to putting members at the centre of what we do.
Lesley said: APS is there to make sure everyone working on construction projects is safe. ‘Simply Safety’ is what we are about and the heart of what we deliver for our members. I will work hand-in-hand with government, devolved administrations and the HSE to ensure laws, rules and regulations are fit for purpose and strive to ensure that APS delivers the continuous training our experts need.
Lesley has 12 years’ frontline government experience in Whitehall, including the Home Office and the Treasury. Before joining Energy UK, she was Board Director, Communications and Public Affairs for the British Bankers’ Association. She has also worked for Transport for London, the NHS and Scottish Power.

Mary-Kathryn Rallings Adams - Director of Research HACT
Mary-Kathryn will give an overview of HACT (Social Value and Procurement: A toolkit for housing providers and contractors) in collaboration with Trowers & Hamlins LLP and echelon Consultancy Ltd a toolkit which was launched earlier this year at CIH.  Following the successful launch of the toolkit, HACT is now taking both the client and contractor perspectives on board in exploring these challenges.

Samantha Granger - Corporate Social Responsibility Manager, Thirteen Housing Group
Samantha will be speaking about the Thirteen Housing Group's employability service "New Directions" and how they will be encouraging all of their contractors to help them achieve their Social Value requirements by supporting them in the future.  

Darush Dodds - Head of Corporate Responsibility and Added Value, Esh Group
Darush will be speaking about how the Esh Group incorporates the elements of Social Value within their wide range of projects demonstrating Corporate Social Responsibility, supporting employability in the region and also assisting smaller SME contractors to achieve social value principles.

Assignment, Novation and Termination

Auckland Castle Site Visit

Simon Davis - Project Manager - Auckland Castle Trust, will provide this exciting visit.

A £2.5m Welcome Centre, featuring a 95ft (29m) tower, to be built in the centre of Bishop Auckland, has been backed by Durham County Council. It will be the gateway to a proposed £17m museum at Auckland Castle - home to the Bishops of Durham for 800 years. The modern and striking structure has been designed by the internationally renowned Niall McLaughlin Architects and is being funded by the Auckland Castle Trust.

It will be sited outside the castle walls on the edge of the Market Place and incorporate a timber framed building and the tower, with an observation platform 15m up offering panoramic views of the surrounding area.

The Welcome Building is part of a raft of ground breaking schemes that will breathe new life into Auckland Castle and the historic market town in which it stands.

Constructing Excellence in the North East are delighted to be holding the North East’s Construction Summit on Tuesday 20th September focussing on the Governments Construction 2025 Strategy along with the recent review for 2016-2020.

The Construction 2025 strategy is at the heart of our vision at Constructing Excellence, and we seek to speed up the rate at which engaged players achieve the targets for improvement. Those targets of improvement include 33% lower costs, 50% lower emissions, 50% faster delivery and 50% improvement in exports. These particular targets will be headlined by five core themes for People, Smart, Sustainable, Growth and Leadership plus the additional ones in the 2016-2020 strategy; Client Capability, Skills and the Supply Chain and Whole-Life approaches.

Staying Strong in Troubled Times

Payment and Pay Less Notices – Getting it right!

The ‘Construction Act’ (“the Act”) requires a paying party under a ‘construction contract’ to issue Payment and Pay Less Notices. The purpose of these notices is to inform the payee of the amount he will be paid by the final date for payment and the basis on which this amount has been calculated. This enables the payee to plan his cash flow and issue similar notices downstream to his subcontractors. 

A more controversial provision under the Act is the remedy for when the paying party does not issue an effective Payment and/or Pay Less notice. In short, the effect of this remedy is to treat an Interim Application submitted by the Payee as the Payment Notice in default. Provided the Interim Application has been submitted in accordance with the contract, the paying party must pay the payee the sum claimed in the interim application whether the valuation by the payee is correct or not.

The reliance on this remedy, especially when there is a difference on valuation has generated many disputes concerning the validity of a Payment or Pay Less Notice and whether an application can be treated as a Payment Notice in default. Given the volume of litigation on this matter, there is now sufficient judicial guidance to highlight what constitutes an effective Payment or Pay Less Notice and in what circumstances an Interim Application may or may not be treated as Payment Notice in default. 

The presentation considers recent case law and standard forms of contract. It will provide a practical demonstration as to how Payment and Pay Less Notices should be drafted and a commentary as to the circumstances in which an Interim Application may be considered a Payment Notice in default.

The presentation will cover the following points:
·         Timing of Payment and Pay Less Notices.
·         What information must a Payment Notice and Pay Less Notice contain and in what level of detail?
·         Can a Pay Less Notice be treated as a late Payment Notice?
·         Can invoices be treated as a Payment Notice?
·         Submission of Payment Notices when there is no change in the amount due since the last payment.
·         Do Payment Notices still have to be served when the payment due dates on a payment schedule expire due to the Completion Date being delayed?
·         Payment Notices and Pay Less Notices after termination and repudiation.
·         Guidance on how Interim Applications should be prepared to ensure that they can be treated as a Payment Notice in default.
·         Claiming legal costs for pursuing an adjudication in the event the paying party refuses to pay the amount included in an Interim Application.

Constructing Excellence in the North East are delighted to be supporting our National office for a fifth consecutive year preparing the Constructing Excellence National Awards. Now in their tenth year, these prestigious Awards seen as one of the highlights of the industry’s calendar will be attended by over 450 built environment professionals from across the UK.

These awards are part of a national programme of nine regional awards covering England and Wales. The 2016 winners at regional level go forward to the National final to be recognised as the CE champions of excellence for the year from categories such as Integration & Collaborative working, Sustainability, Young Achiever (G4C) and Health & Safety.

Following the Awards, those winners are invited to a special reception in the Houses of Parliament to showcase their achievement and to represent the best of our sector to MPs, members of the House of Lords, and movers and shakers in our industry.

Generation4Change North East with the support of RIBA North East and CIBSE Young Engineers Network are delighted to be holding their annual charity quiz night on Wednesday 9th November at The Centre for Life and we would be delighted if you were able to join us for a fun filled evening with a variety of themed rounds to test everyone’s ability.

We will be raising funds for Metro Radio's Cash for Kids a North East based Charity.

Cash for Kids is a local charity, and it is our mission to support local children who are disabled, disadvantaged, sick, or suffering from abuse or neglect, from the ages of 0-18. All the funds for the charity are raised locally, and redistributed locally, to individuals, families and other charities dedicated to improving the lives of young people.
We are proud to operate an 80% contribution across the UK, with clear visibility on where the money goes and who it is helping. However, at Metro Radio Cash For Kids, our last audit in 2015 showed that our contribution was much higher, with at least 90 pence in every pound donated going directly to the children we help to support.

NCT Skills Annual Employer Event

NCT Skills for Life would like to invite you to our Employer Event on Wednesday 14th September at our Training Centre in Newcastle from 10am until 1pm.  We will be showcasing our learners’ work in Joinery, Bricklaying, Roofing and Plastering, giving you an insight into the high standard of work they deliver as part of their Apprenticeship. 

This will be an excellent opportunity to ask our staff any questions you may have about taking on your first apprentice, or increasing your apprentice intake. You can also determine whether you may be eligible for funding to support taking on an apprentice.

North East Mayoral Candidate Jeremy Middleton CBE will also be joining us to open A6, the new home of our roofing and joinery learners.

After the formalities we will be serving a delicious Hog Roast and giving attendees the opportunity to network.
